We. Are. Closed...

....finally.

Buying this house has been one of the worst ordeals of my entire life, thanks to the builder's "preferred" lender and the builder's realtor.

I never want to buy another house....EVER.


The builder nor his realtor showed up for the final walk-through.  One of the A/C units was frozen and covered in ice.

The lender repeatedly messed up the paperwork throughout this process, providing inaccurate excuses about why things were delayed, so that closing was postponed not once, not twice, but three times.  We received the final settlement papers from the lender at 12:20 yesterday; our closing was at 1:00.  The amount was thousands of dollars more than what the lender had previously provided to us.  Because of the extra expenses due to the closing delays, we didn't have those thousands of dollars to close this house. The lender refused to accept responsibility.

At 5 minutes prior to our closing time, our realtor was still trying to get accurate information from the lender.  He was not returning phone calls because he knew he had screwed everything up and had not been up front with us about closing costs.

We missed our closing; the attorney had to leave. 

Our realtor negotiated the closing costs down a little, but still not enough for us to have the money to screen-in the porch.  The lack of a screened-in porch was a total deal-breaker for us when we were looking for houses.  This house did not have one, but by using the builder's preferred lender and the supposed discounted closing costs, we would have the money to have it built.

The attorney was kind enough to work us in at the end of the day so that we could close.

The builder's realtor did not show up at closing and told us we could drive to her office, 20 miles away, if we wanted the keys to our house.  Our realtor had a key and gave it to us so that we could at least go to the house last night.

We were exhausted but decided to drive over.

When we got there, the back of our house had been ruined.  In addition to the increased closing costs, part of the paperwork delay yesterday had to do with the screened-in porch.  An addendum had been added to the contract on the house stating the builder would install the screen after closing.  The lender included the addendum, which he was not supposed to do since it was to be built AFTER the purchase.

The FHA red-flagged it and wanted temporary railings installed immediately.  While we were sitting in the realtor's office waiting to close, the lender sent his 3-year-old grandson over to our house to install the temporary railing.  An eyesore does not even begin to describe this railing....the wood is what you would find in a broken box of Lincoln Logs, except it is all raw wood...bottom of the next barrel raw wood.  Now, there are huge holes in the brick of our house, the beautiful cedar poles, and our sidewalk.  Because the lender was inept and did not give us correct closing figures, we are stuck with this eyesore until we can save enough money to have the porch screened in.

Two inept, uncaring people have made this process a complete nightmare.

Throughout the closing ordeal yesterday, our realtor was trying to negotiate with the builder's realtor for them to allow concessions for screening-in the porch because their lender had caused us so much trouble.  We contacted our realtor last night letting him know about the damage to the house and the hubster sent a lengthy email this morning, with photos of the damage.

We still don't know if the A/C unit is properly repaired or not.  No one has provided information to us or our realtor.

While at the house last night, our neighbors, who were so sweet and welcoming, came over to discuss the eyesore on the back of the house.  Naturally, the HOA is going to want this fixed immediately.  We explained what we had been through.  They told us their lender matched the deal the builder's lender had offered.  We are having a sign made that will give the name and contact information of their lender who matched the deal that was offered by the builder's lender.  There are 30+ houses yet to be built and sold in this neighborhood.  Everyone that comes into this neighborhood has to drive by our house.    We will make sure the builder's lender will not be used in the sale of those houses.  No one else will have to go through what we've been through.

I have been in tears for two days and am still crying this morning.

I am not excited.

I do not want to move.

Maybe after the dust is settled, I will feel better....I don't know.

On the flip side, I cannot say enough wonderful things about our realtor, Clausen Group.  Matt, Bryan, and Nancy Jo have been fantastic.  Matt and Bryan have stayed on top of everything and have been our advocates through this entire process.   Everyone we talk to will know to use this realty group.  This was our gift from them at closing..


That box holds a gift card to Hobby Lobby....how did they know it was one of my most favorite stores?!

    1. Thank you Rita, we are hoping our realtors can get a satisfactory resolution. We haven't heard a response from our realtor yet. Of course, the hubster sent it over at 7:00 this morning because we've hardly slept...so it may be a while before they can get on top of it for us. I can't even talk about it without bawling, so I hope they don't want to talk on the phone. :-/

  2. Oh Benita, I am so sorry. What a mess. I cannot believe that you went through this and still have a disaster and construction to contend with. Yikes. I am glad that you had a sweet realty team backing you up, but gosh, the rest of it sounds very traumatic. Forget Hobby Lobby, sounds like you need a vacation certificate. Hugs...

    1. Thank you so much, you are so sweet! And yes, a vacation from this mess would be awesome! Our realtors are absolutely the best, I cannot say enough wonderful things about them. And, they see Reba on a regular basis. ;-) We are still in shock mode after seeing that mess at the house...it was truly unbelievable and now we have to fight to get it properly repaired! So we don't even have an end to the nightmare in sight, at this point! Hugs!!

Even if we had money to toss away, we wouldn't do it because it's just not right for someone to do these things and not be held accountable.   4. What a nightmare, Benita! And I thought we had a rough closing! I agree, someone should pay for the damage! I am so sorry! At least you were offered the keys, the sellers to our home said they lost ours, and that one of the painters probably kept them. Of course we changed the locks, and according to them, we are holding their lock box hostage, when we've made numerous phone calls for them to pick it up! I agree very childish! I'd be so happy with a gift card to Hobby Lobby too! =)

    1. I didn't want to close, at all. I had already been in tears all morning. When we arrived at their office, we told them we weren't closing, that we just didn't feel good about any of it and that there were way too many problems with this deal.

      Our realtor was so nice and agreed that it had been a mess and apologized profusely for everything. He said they understood and couldn't blame us for wanting to not close on this house. He and the attorney sat with us and looked over the entire contract and the documents we signed when we put the contract on the house. They said the builder had covered his rear-end with the contract and that if we didn't close, he could and would sue us, because they were already in court with another builder who sued someone for not closing.

      Since the problems are not with the house itself, nor with the builder, the builder would win the case. If there were problems with the house or this had been construction issues, then we would have a legitimate reason for not closing. The A/C is under warranty and would be covered by the manufacturer's warranty, so we couldn't use that as a bargaining chip.

      The builder isn't responsible for the lender's issues, so at that point, we were stuck. We couldn't afford to be sued. Now it will be the lender's responsibility to repair all of the damage to the house since this was their doing and not the builder's. We have been just sick about it all.

  6. Oh Benita I am so sorry this has all happened. This is so wrong on so many levels. I think I would get a lawyer if this does not get resolved with your realtor. Here in Illinois you can walk away up to 3 days after the closing and not be legally bound with situations like yours. Can you do this in Tennessee? If you walk that might just put this builder on things quicker. Sometimes these builders are so use to being sued they don't give a care to that but if you walk away and he does not get his money that might work faster for resolution. Sorry your home buying has to be so stressful. This should be a happy time not one of sleepless nights and despair. So sorry.

    1. Thank you so much Kris! It is very wrong and all of this is strictly because of the lender! We are discussing our options if the lender will not agree to pay for the damage to the house. Edward looked up "walk away" when I read your comment and no, it is not an option here in Tennessee. It should definitely be a happy experience, but this lender and the builder's realtor have made it quite miserable!

We are hoping we can get it resolved quickly, because I don't think I can look out the French doors at that mess every day. And the HOA is probably going to demand that it be repaired quickly.   8. OMGosh...well first off, if i lived closer 1. I would give you a big hug, 2. I would make you a giant pitcher of margaritas, and 3. We would go find the builders office and i would punch him in the nose for you!!
    I feel so bad for you, but i know how it is, they have you right where they want you! When we closed on this house we were moving from Canada to here which was stressful in itself, we were not used to how US closings worked, we had no US credit so money was very tight...and this house was staged very well by the homeowner...but our inspector found lots of issues that we fought and fought over and they would not fix or the ones they did fix were shody. Then on our closing inspection we found that they had left behind all their garbage and all the carpets were stained with dig pee, an expense of ripping out carpet we could not affors, but had to because we have adog who has never peed in the house and did not want him to start because of the other dogs scent! The previous homeowners had stragecially put furniture and. Rugs over the pee. They also had huge shody patch jobs and holes in the walls. And their realtor was a jerk during the closing. But in the end we went through with it... Why, because they had us, we were in no position to be able to start over time wise. I hope your realtor can help you resolve this. Does your association hold any weight to help? I think threatening them with the sign is a good idea, i have seen that done here before with success. That builder should be ashamed of himself! I cannot even begin to imagine going through this in a different country and not knowing how it all worked. That was truly extra stress indeed! And horrible of a person to do those things just to try to save themselves some money and then to leave you with the task of fixing what they messed up and cleaning up their mess....disgusting. It makes you wonder how people can live with themselves when they treat people that way!!

      Being behind the eight ball, so to speak, is never a good place to be. We couldn't walk either because the problems were not the builder's fault, but were associates of his. He had legal grounds to sue us and we can't afford that. We also have a time issue because we have to be out of this house....it is so sickening to be stuck and not be able to do anything about it! Thank you so much, you are so sweet! Our realtor is diligently working on it now so I hope that there is some resolution for us that can take place pretty quickly!

  9. Benita....I feel so bad for you and your husband. Sorry to say that incompetence is more the norm than not anymore. That is the reason it has taken my husband and I 18 months and still going to get our house built. We had to have our first basement completely removed and start over because of poor construction work. Isn't there some Builders Association and Realtor groups you can file a complaint with in your state? Also the BBB, Angie's list and State Attorney Generals office would be good places to file complaints, to put black marks on their names and maybe help someone else down the road so that they do not hire these people. Take care and know that I truly feel for you. Hopefully your realtor will be able to get some type of satisfactory solution for you.

    1. Girl, I feel bad for you guys! Our little problem is nothing compared to what you have had to deal with. It seems that it is always an uphill battle when it comes to a house. Our realtor has been working with them today and I had a chance to talk with them also. They are being really good about "making things right" and have already started repairing our house. We are still in negotiations on the screening, but will get it resolved. The builder was apologetic about everything!

We've had some good conversations with the builder today and they have already started making the necessary repairs to the house and cannot stop apologizing enough for all of the problems.   12. I agree with Bon Bon...surely there is a State Agency that you can report the lender AND the builder to. He must have had an arrangement of a kickback somehow with the lender. I had been so impressed with the list of things to look for in a new home that I had forwarded it to some friends. What a shyster! I would be paranoid that he was such a shyster that there would be issues with his building expertise. Did you contact the tv station? Can they sue you for defamation over a sign? I'm SOOOOOOOO sorry!!!!!!! Surely the HOA will be understanding...talk to them so you won't have that stress to worry about.

We specifically asked about the sign and as long as we are not naming names, there is nothing they can do and they can't take it down because it would be trespassing. We thought the same thing, that the lender and builder were receiving kickbacks from each other for the loans, but we have no way to find out. Our realtor has been talking with them today and I had an opportunity to talk to the builder. He has been extremely apologetic and wants to do whatever he can to make things right with us. They have already started repairs to the house, which was a good sign for us. We are still negotiating about the screening and hopefully they will make good on that as well. Since they are still building on our street, we will see them everyday, so I feel certain he will want that sign removed as quickly as possible. Thank you again so much! I feel better after our conversations today....just really looking forward to getting some sleep tonight! :-)

    1. When we walked into our realtor's office yesterday, we told him we didn't want to close. The phone calls started flying every which way at that point. It was just a mess. Our realtor has talked to the builder today and I have talked to the builder. He was very apologetic for all of the mess and they have already started making the repairs on the house. We don't know yet about the screening, but I feel certain they will make all of this right!

You are such a joyful person and this house is so important to you that I hate for anything to have spoiled it in anyway for you. It just plain stinks. After reading some of your replies to comments above, I understand why you almost had to close. Lord have mercy, there just isn't a lot you can do, is there? I'll just pray that your happiness in this move and this house will come back and the good things about it will triumph over the rotten things that happened in this closing. And that eventually this screened porch will be transformed into the place you had pictured it being and become the spot where you will find solace and peace and healing.

    1. Dewena, thank you so much! You are just so sweet! Our realtor has chatted with the builder and I have chatted with the builder. They came to the house to start making the necessary repairs. He couldn't stop apologizing for all of the problems and said they would make all of this right. I felt better after that. We still have no word on the screening, but I feel sure they will fix it all for us. After all of the tears and frustration, I do feel some better this evening. I realized that in the big scheme of things, this is just a small blip in the road and while it is disappointing, it will get better and the problems will be fixed.       i'm speechless.
      i've never seen such a mess in my life. it was fishy and problematic from the git'go.
      and they didn't know you like hobby lobby.
      the realtors did the same thing for me when i sold my little cottage.
      trust me. it's standard operating procedure.
      i know you think they're great.
      but in this case . . .
      NOBODY seemed to be protecting the BUYER. YOU.
      i think i'd be tempted to take plenty of pictures of the ruined back of the house . . .
      and then let them have their day in court. the lender should be shot at dawn. and the builder.
      and the ....
      you can tell how mad i am on your behalf.
      it makes me want to scream.
      i'd take it to the housing commission and the better business bureau and anyone else i could.
      and i'd find a neat little place to rent. i'd put my STUFF in storage...
      and get my life back to calm and simple ... and RELAXED... until it all got back to normal.
      this kind of thing makes for heart attacks. no house or stuff is worth it.

      We didn’t want to close and your previous comment were the exact words I told the hubster…that it just didn’t feel right because of all the obstacles. And because I’ve experienced so much anxiety about this purchase. But the realtor and attorney said if we didn’t close, then the builder could sue (they said some builders sew their contracts up tight so you have no out), so we couldn’t afford that either. Those cards are SOP??? Man, and I thought they were thoughtful in doing that because no other realtor has done that for me before…DANG!! We did feel like we were just left out in the cold, but late this afternoon, things did start looking up. The builder came by to start making repairs on the house and kept apologizing over and over for all of the mess and damage to the house. They will finish the repairs tomorrow. Our realtor is working on getting the screening taken care of so hopefully those negotiations will be handled before too long. We are exhausted and are so looking forward to a good night’s sleep tonight!!     4. Tammy, you are just a most precious woman!! I so wish that we lived closer so that we could visit in person! I have been working on changing my attitude about this whole mess because it has really thrown me for a loop. While at the house yesterday (moving more of those breakable items I don’t want the movers touching), I was looking around and trying to see all of the things I loved about this house. I started feeling better as I imagined our furniture in the house and all of the fall decorations scattered about. It was calming and after it is all said and I done, I think we will be happy here. It will be our haven and all of the ugly turmoil and hurt to get here will eventually fall away. And you are so right, we have fought the good fight…I think those people got so much more than they bargained for when they angered a hot-headed 5’2” Italian woman. :-) Hugs!!!!     1. Thank you so much Donna! We tried out best to get out of it, but the builder's contract was solid. We would be sued. Our realtor has talked to them and then I got a chance to talk to them and they are all working to make things right for us....so that is great news and I feel much better! At least we will get some rest tonight!

    I am not sure about this deal either-you can see we are all concerned for you, I am worried. I know that you wanted to have a home and just to get this over with. So of course I will support you, but I do think you need to be on your toes, document, take pictures, seek the advice of an attorney. I just don't think that any of these people can be trusted including your agent.

    1. Thank you so much Jemma! We have done exactly that...taken photos, written down our conversations and have saved all of the emails. I feel a little better after talking with the builder today and after they started making the repairs, but am definitely watching everything they do and making sure it is done properly. They are still building on the street and I will see them every single day. I explained to the builder today that at this point, we can trust none of them because of all the false information we received and because of all the finger-pointing and double-talk. He apologized over and over. I told him that when a company or person associates themselves with someone who is not "like-minded" then their credibility gets called into question also. At this point, I think they will make good on everything, it is just going to require more time to get things done. It is disappointing, that's for sure! I've been a crying mess so far, but we moved some things yesterday, so at least it kept me a little distracted...and the builder has been trying to take care of things for us, so that is positive.   21. Benita, this is just awful awful. I wish I knew a lawyer in the area I could send you. If it went to a suit, I don't see how you could lose, but I know you certainly don't want to have to deal with that. When we got to our closing, my husband said, my "claws came out." Sometimes you just have to do that! BUT if the builder showed up today, do you suppose it is because he got wind of your sign?? PR can make a big difference in what someone does (and how fast they do it.) I think the sign idea is brilliant! Best wishes. Gosh it has to get better from here! You have been through the worst.

LOL…this sort of stuff definitely makes the claws some out! And sometimes it is totally necessary to get a point across. These men don’t understand how many different types of “scorning” there can be with women and that a tornado always comes behind the anger and tears. The builder knows about the sign as the email talking about the sign was sent to every participating party. And even in a world buried in social media, “word of mouth” is still a business killer. Thank you so much for your sweet comments….it has been a little better since Tuesday and we are making progress in getting things resolved! :-)

    1. Thank you so much! After all of that horrible-ness, we have finally gotten moved and are getting settled in the new place. They have all been working with us, so these issues are getting resolved, which makes me feel better! Hope you’ve had a great Labor Day!!

  24. What an ordeal!! I hope the fixed the AC unit. I used to work in a HVAC company and a frozen unit is never a good sign. You are so sweet and I'm sure things will work for you. Hoping you enjoyed your Labor Day

    1. Honey, it was a total nightmare. They did get the problem fixed and it has been working great! I've talked to the HVAC company that installed it and she assured me all was well. At least now I have a direct contact if something else happens with it. Thanks so much Steph! Hope you had a great weekend!

  25. What a nightmare you have been through. I am so sorry. I'd be tempted to call the local media and have them do a story on what you have been through and the damage to the house so that even more people will know about it and avoid them like that plague. It might even put the pressure on to make things right.

    1. Debbie, we were very tempted and threatened with calling local media and with the sign. Thankfully, they have been wonderful about correcting issues and will start on the screening next week! We are finally moved and are in the process of getting settled and hopefully going to love our new home despite their best efforts to ruin it for us! Hope you are having a great week!!
